Scope. This Privacy Statement covers all of Share Magnet dba Social Rebate (“SR”) and the Social Rebate Program. It does not, however, apply to entities that Share Magnet does not own or control. By using or accessing SR, the Social Rebate Program, or any websites owned or controlled by SR, which include www.sharemagnet.com and www.socialrebate.com, you consent to be bound by our  privacy statement. If you do not agree to these terms, please do not use the Social Rebate Program or SR. Each time you use the Social Rebate Program or SR, the current version of this policy applies. Accordingly, you should check the policy regularly and review any changes.

Changes to this Statement. Please note that we may change our Privacy Statement at any time and without prior notice, by posting the revised version of this policy on our website.

No information from children under age 13. If you are under age 13, please do not attempt to register for the Social Rebate Program or with SR or provide any personal information to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe we might have any information from a child under age 13, please contact us via message from our SR “Contact Us” page.

Parental participation. We strongly recommend that minors 13 years of age or older ask their parents for permission before sending information about themselves to anyone over the internet and we encourage parents to teach their children about safe internet use practices.

Information We Collect

Information you provide to us:
Information About Yourself. When you sign up for the Social Rebate Program and/or purchase/download the Social Rebate App (“App”), or claim a Social Rebate or make a purchase through the Program, you may voluntarily provide personal information such as your name and email address. In addition, you give SR permission to access your basic Profile information on third party social media platform/apps such as Facebook as defined on the App’s Request Confirm page, such as your login information, name, email address and contacts/friends list.  You become a Social Rebate User or Buyer when you accept a Social Rebate offer/promotion, which enables SR to track clicks from your network of friends and acquaintances on social networks (“Network”).  In some cases, we may ask for additional information to provide specific services to you. (For example, we may require an address or social security number for income tax reporting purposes and/or to provide a 1099 form if necessary. Please note that we will request such information only when necessary. We will maintain this information in encrypted form on secure servers.)

Transactional Information. We may retain the details of every transaction or payment made through SR.  We require the personal information described above in part in order to be able to have payment processed to your PayPal account (or other applicable payment gateway account) upon your successful participation in a Social Rebate Program. However, we neither hold nor share any personal financial information about you, such as credit card information, and you actually share such information directly with our secure payment processor/app which processes certain data on our behalf in order to execute given transactions for your benefit. 

Corrections/Information Removal/Opt-Out. If you change your name, e-mail address, mailing address, telephone number or other personal information, you may update, correct or omit the relevant information by visiting our site. 

Information we collect when you interact with SR:

Aggregate Information. SR collects aggregate personal information (non-personally identifiable information) such as frequency of visits to SR, browser type, etc. No single person can be identified by this aggregated and often anonymized information. SR uses aggregate information to provide and optimize its services and remuneration, as well as to monitor, audit and analyze data pertaining to our business metrics, and to engage third party service providers to help SR improve operations.

Cookie Information. We use “cookies” (small pieces of data we store on your computer, mobile phone or other device) to make our sites and Apps easier to use, make our services better, and to protect both you and SR. We store minimal information in cookies and protect this information. (For example, we do not store any complete records or credit card numbers in a cookie). You can remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use SR.

Use of Pixel Tags/Clear GIFs/Web Beacons

A pixel tag, also known as a clear GIF or web beacon, is an invisible tag placed on certain pages of our website but not on your computer. When you access certain SR pages, pixel tags may generate a generic notice of that visit. These usually work in conjunction with cookies, registering when a particular computer visits a particular page. If you turn off cookies, the pixel tag will simply detect an anonymous website visit.

Links to Other Websites

SR may contain links to websites operated by other people or companies, such as Facebook and payment processors. Those websites generally have their own privacy policy, and it is possible that a website will have no privacy policy at all. SR does not have any responsibility for those websites, we provide the links solely for the convenience of our visitors and Users.

No Sensitive Personal Information

We neither collect, store, access or share any sensitive personal information, such as your personal financial information and credit card information.  In order to permit payment to you, you may reveal credit card information to our payment gateways (such as Paypal) on their secure webpages. 

How We Use Your Information

We use the information we collect to try to provide a safe, efficient and customized experience. Here are some of the details:

To contact you. We may contact you with service-related announcements from time to time.

To manage the Social Rebate Program. We use the information we collect to provide our services and features to you, such as ensuring that you are paid any Social Rebates or other rewards you are due, and to provide customer support. We do not share any of your personal or User information relating to your use of the Social Rebate Program with any third parties, except to the Store that pays the Social Rebate via SR to you.  We also use the information to prevent unacceptable or potentially illegal activities, and to enforce our Terms of Service. We also use a variety of technological systems to detect and address fraudulent activity and to prevent abuse such as spam. These efforts may on occasion result in a temporary or permanent suspension or termination of some functions for some users.

Contests/Sweepstakes. From time-to-time, we may request information from users for participation in a contest or sweepstakes. Participation is completely voluntary. Accordingly, the User retains the choice whether or not to disclose this information. We may request contact information and/or supplementary information on your interests, opinions and preferences. We will use the contact information to notify winners. We may publish the winners’ first name, last initial and city of residence on the website. And we may be required by law to share (i) winners’ first name, last name and address with state agencies and (ii) winners’ first and last name with persons requesting such information by mail.

Sharing, Selling and Trading Aggregate Information Collected Online with Third Parties. We may share, sell or trade with third parties the aggregated, often anonymized, non-personal information (e.g. number of users who searched for a particular term). We may use this data for the purpose of case studies.  However, as stated earlier, this information does not identify you individually.  We will not share any PII with third parties who are not processing data on our behalf without your express consent.

Your Rights regarding Personal Information

You have the right to access your personal data/personally identifiable information (PII).  You may choose to opt out of certain disclosure if you do not want your information disclosed to a third party or be used for a purpose materially different than the purpose for which it was originally collected or subsequently authorized by you (unless the disclosure is merely to an agent performing tasks for us under our instructions or control)..  You may request that we update, correct, amend or delete any of the PII or other information we have collected from you, or you may opt out of receiving SR notifications and emails and other communications such as newsletters, by messaging us via the SR “Contact Us” page.  We may choose not to fulfill any request that we determine is illegal or where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy, or where the rights of persons other than the individual would be violated, but our intention is to comply with opt-out requests, and other requests that seek to correct, update or delete your PII, as fully as possible in accordance with applicable law. You will also be given notice should we use your PII for a purpose other than that for which it was originally collected or processed.  We do not ask for, collect or knowingly receive sensitive PII, i.e., PII specifying medical or health conditions, racial or ethnic origin, political opinions, religious beliefs, or information relating to sex life.  Organizations that seek or disclose such sensitive PII must receive your affirmative express consent (opt in) before disclosing it to a third party or using it for a purpose other than that for which it was originally collected or subsequently authorized.

Notwithstanding the foregoing, you acknowledge that your participation in the Social Rebate Program and in any Promotion, as well as your right to receive Social Rebates, constitutes your agreement: (1) to have SR share the PII you have provided to us with the appropriate Store that offers a given Promotion, (2) to receive additional Promotions from the same Store and its affiliates, as well as updates to existing Promotions, from both the Store (and affiliates) and SR, and (3) to have SR provide you with any or all Promotions on all Stores, so that you can maximize the value of the Social Rebate Program by claiming multiple Social Rebates.  Consistent with the Privacy Statement, in the event that in the future you no longer wish to receive such Promotions or updates, you will have the right to unsubscribe to some or all of them. 

How We Protect Information

Security Pertaining to Your Information. SR takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. However, no method of transmission over the Internet is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

IN NO EVENT WILL SR OR ITS SUBSIDIARIES, AFFILIATES OR ANY PARTY INVOLVED IN DELIVERING THE SR AND SOCIAL REBATE WEBSITES (“WEBSITES”) OR THE SOCIAL REBATE PROGRAM BE LIABLE IN ANY MANNER WHATSOEVER FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS, USE OR INABILITY TO USE THE WEBSITES OR THE PROGRAM, OR IN CONNECTION WITH ANY FAILURE OR PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE (INCLUDING LOST PROFITS, LOSS OF BUSINESS OR DATA, BUSINESS INTERRUPTION, AND DAMAGES THAT RESULT FROM INACCURACY OF THE INFORMATION OR INCONVENIENCE, DELAY OR LOSS OF THE USE OF THE WEBSITES OR PROGRAM). THE FOREGOING LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER BASIS, EVEN IF SR OR ITS AFFILIATES OR ANY OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Integrity of Your Data. SR processes personal information only for the purposes for which it was collected and in accordance with this Statement. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete and current, but we depend on our users to update or correct their personal information whenever necessary.

If you are a copyright owner or an agent thereof and believe that any submission on SR message boards chat rooms or any other content on the Websites or in connection with the Program infringes your copyrights, you may submit a notification pursuant to Title 17, United States Code, Section 512(c)(3), the Digital Millennium Copyright Act (DMCA) by providing our designated copyright agent with the following in writing to info@socialrebate.com:

(i)    A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

(ii)    Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

(iii)    Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled information reasonably sufficient to permit the service provider to locate the material;

(iv)    Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, electronic mail;

(v)    A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

(vi)    A statement that the information in the notification is accurate, and under penalty of perjury that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Failure to comply with the all of the aforementioned requirements may render your DMCA notice invalid.
